Terms of Service

AfterNine ("AfterNine", "we", "us", or "our") operates an adult-oriented directory and advertising platform. These Terms form a binding agreement between you and AfterNine.

The platform contains adult material. You may not access or use AfterNine unless you are at least eighteen (18) years old, have reached the age of majority where you live, and may lawfully view and publish adult-oriented content in your jurisdiction.

By using AfterNine, you represent that:

• You are using the platform voluntarily and without coercion.
• You have legal capacity to agree to these Terms for yourself or the business you represent.
• The information you provide to us is accurate, current, and not misleading.
• You will comply with all laws that apply to your access, advertising, communications, and conduct.

AfterNine is a venue for adult professionals to publish profiles and for adult visitors to view, save, and contact those profiles. We provide hosting, discovery, account tools, messaging features, safety reporting, billing for platform features, and optional promotional placement.

AfterNine does not provide adult services, employ providers, act as an agency, broker appointments, negotiate terms between users, arrange meetings, verify the legality of any off-platform arrangement, or guarantee the identity, availability, performance, safety, or conduct of any user.

Any communication, meeting, screening decision, deposit, fee, gratuity, or other arrangement connected to a provider listing is solely between the people involved. We do not collect, hold, escrow, transmit, refund, or settle payments for services advertised by users.

You can browse some public areas without an account, but saved profiles, messaging, provider applications, ads, subscriptions, and billing tools require registration. You are responsible for your username, password, passkeys, multi-factor settings, recovery codes, and all activity under your account.

Providers must complete age and identity verification before a public profile may be approved. We may request identification, current verification photos, contact details, or other materials needed to review an application. Submitting verification materials does not guarantee approval.

• Do not sell, lease, transfer, or share control of your account.
• Do not create duplicate accounts to evade moderation, billing limits, profile restrictions, or verification decisions.
• Provider profiles must represent the person advertised, not a fictional persona, unrelated third party, or shared business identity.
• If you believe your account has been accessed without permission, contact security@afternine.net promptly.

You are solely responsible for every profile, ad, photo, video, biography, rate note, testimonial, message, report, link, and other material you submit or make available through AfterNine ("User Content"). User Content must be lawful, truthful, consent-based, and consistent with these Terms and our platform policies.

By posting User Content, you confirm that you own it or have all rights, permissions, licenses, releases, and consents needed to post it. You also grant AfterNine a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, display, transmit, moderate, remove, and promote that content as needed to operate and market the platform.

Public listings are not confidential. You should keep your own copies of anything important, because the platform is not intended to be your only archive for photos, messages, documents, or business records.

AfterNine is available only for lawful, consensual adult advertising and discovery. We have zero tolerance for minors, exploitation, trafficking, coercion, non-consensual material, or attempts to use the platform for illegal activity. Report suspected violations through Report Abuse or by emailing support@afternine.net.

You agree not to use AfterNine to:

• Post, request, promote, or facilitate content or activity involving anyone under 18, sexual exploitation, human trafficking, coercion, blackmail, or non-consensual sexual themes.
• Harass, threaten, shame, stalk, impersonate, defame, discriminate against, or expose private information about another person.
• Upload malware, phish for credentials, interfere with the platform, probe non-public systems, or access data you are not authorized to access.
• Scrape, crawl, data mine, bulk download, frame, mirror, or republish platform content without our written permission.
• Post false, misleading, infringing, hateful, violent, obscene, spammy, scam-related, or otherwise unlawful material.
• Advertise weapons, controlled substances, stolen goods, fraudulent documents, or any product or service whose advertising or sale is unlawful.
• Encourage another person to violate these Terms or help them evade enforcement.

AfterNine may offer paid platform credits, subscription plans, featured placement, promotional bidding, and similar account features. Credits are an internal accounting unit used only inside AfterNine. They are not cash, stored value, legal tender, a bank deposit, or a right to receive payment from us.

Subscriptions unlock the feature set shown at the time you select a plan. Subscription charges are debited from your platform credit balance at the applicable billing interval. If your balance is insufficient, we may decline the change, downgrade the subscription, hide excess ads or media, or suspend paid features until the account is funded again.

Featured placement may be allocated through automated auctions or other ranking systems. If you activate bidding, you authorize AfterNine to debit your credits for winning placements up to the bids, caps, and settings you configure. Featured placement improves visibility but does not promise impressions, contacts, bookings, revenue, or any particular outcome.

• Platform-credit purchases are final except where a refund is required by law or approved by us.
• Bonus, promotional, or manually granted credits may expire, be revoked, or be limited to particular features.
• We may reverse credits, suspend features, or close accounts connected to fraud, abuse, payment failure, sanctions concerns, or chargebacks.
• Chargeback fees, processor fees, network fees, or taxes may be passed through or deducted from your balance where permitted.

The platform may link to, embed, route through, or interoperate with third-party services such as payment processors, hosting providers, email providers, maps, analytics, abuse-prevention vendors, or external websites linked from user profiles.

We do not control third-party services or user-linked websites. Your use of them may be subject to separate terms, fees, availability limits, privacy practices, and dispute processes. AfterNine is not responsible for third-party content, claims, products, losses, outages, or transactions.

We may review, refuse, remove, edit, move, hide, rank, restrict, or preserve content and accounts at our discretion, including when we believe a profile violates these Terms, creates safety risk, harms the platform, exposes us or users to legal risk, or falls below our quality standards.

We may suspend or terminate access to AfterNine with or without notice, and you agree not to attempt to use the platform after termination. You may close your account at any time, but closure does not erase obligations that arose before closure, including unpaid charges, investigation records, legal requests, or records we must keep for compliance, tax, billing, fraud prevention, or safety purposes.

Access may be interrupted by maintenance, security work, vendor issues, network problems, legal restrictions, or events outside our control. We may change, limit, discontinue, or replace any part of the platform without liability to you.

The AfterNine name, logos, interface, directory layout, software, code, databases, text, design, and other platform materials are owned by AfterNine or our licensors and are protected by intellectual-property and unfair-competition laws. Except as allowed by the platform itself, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the platform.

We respect intellectual-property rights and respond to properly formed takedown notices. If you believe content on AfterNine infringes your copyright or other rights, use our DMCA / Takedown process and provide enough detail for us to locate and review the material. Repeat infringers may have their accounts disabled or terminated.

You use AfterNine at your own risk. The platform and all content are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or uninterrupted operation.

We do not pre-screen every item of User Content and do not endorse or guarantee any listing, profile, recommendation, message, rate, review, link, or user. You are responsible for evaluating information and taking appropriate safety precautions before interacting with anyone on or off the platform.

To the fullest extent permitted by law, you release AfterNine, our affiliates, directors, officers, employees, contractors, agents, vendors, and licensors from claims, demands, losses, and damages arising from disputes with other users or third parties. If you are a California resident, this release includes unknown claims and you waive protections that would otherwise preserve them, including California Civil Code § 1542.

You agree to defend, indemnify, and hold the same parties harmless from claims, damages, liabilities, penalties, costs, and reasonable attorneys' fees arising from your User Content, your use of AfterNine, your off-platform interactions, your violation of these Terms, or your infringement of another person's rights.

We may update these Terms from time to time. When changes are material, we will try to provide notice by email, in-account notice, or a notice on the platform before they take effect. Continued use of AfterNine after the effective date means you accept the updated Terms.

These Terms, together with policies referenced in them, are the entire agreement between you and AfterNine for use of the platform. If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. There are no third-party beneficiaries to these Terms unless they expressly say otherwise.
